there are labels in the business of SELLING bootlegs. there are also labels in the business of selling records containing uncleared samples. i remember a panel discussion on the subject at CMJ in the late 80's featuring paul simon, madonna, chuck d, and some other industry folks. paul simon was attacking the use of the james brown's scream in "it takes two" (which has itself been resampled ad nauseum) and chuck d and madonna beat him down. madonna is a very smart cookie.

No, the point is that there is a four decade history of underground sampling and even longer of bootlegging. To attempt to make an issue out of one example is completely arbitrary and ahistorical.
