thou can indeed steal as long as the people you're stealing from don't smell a payday.
win win really, sample all you want and you're unlikely to get hassled unless it becomes really popular- if it gets really popular then you might need to pay out but by then you could be as famous as baauer with the DJ fees to match.

Baauer's failure to license the samples would appear to stem from some combination of naivety, laziness and stupidity

Yet oddly had this song not been raped to death by mutants on youtube the world over, neither of these guys would have ever known about it and would recive the princely sum of.... fuck all for their "part" in it.

Sure there is a rapper right now about to get sued into oblivion for a similar case. Might have mentioned it in the article but i stopped reading after they went on to tell the history of sampling.

He made a track with some samples that he hasn't cleared and it blew up...these things happen. Not the end of the world as we know it.

The shame is these "journalists" have next to no clue (nor do they seem to want to do the actual research for their articles) as to what a large role sampling plays in certain genres that aren't pop or top 40.

Guardian is usually quite on the ball with their electronic music obvervations...this just smacks of trying to shoe horn in a 'topical' story about a current global trend.

Where do producers stand when they sample bits of film tracks, stuff like voice snippets and quotes. Something quite common in dubstep, who would you go to to clear that, could you be sued for it? I was wondering this recently.

tbh i dont get why people would wanna sue you over a 2-second drum sample like how it says in the article. Sure you might get money, but doesnt that make you feel incredibly selfish as an artist? I wouldnt push charges against something like that lol
