This don't make sense - but it's not uk law so I can't say much.
But here in the uk i'm sure a trademark application would fail under section 3 (the absolute grounds for refusal) subsection D "trade marks which consist exclusively of signs or indications which have become customary in the current language or in thebona fide and established practices of the trade:"
Or perhaps even section s.3 (1) (b) - devoid of distinctive character?
For example, you can't trademark the word 'hoover'
But i can't say the USA IP law is the same as the UK.
