Trademark names

Post by zillion » Fri Jun 20, 2008 9:50 am

So i went on my myspace the other and had a message from breakthrough hospitality. I was well chuffed till i opened it and all they said was i had to change my name as zillion had been trademarked.

Anyone else had this problem?

What can i do? apart from think of a new name.

Cheers

Plasticman had this problem didn't he?

Also a house dj called Anna Kiss (think it was the other way round where she had to prove she had been using the name for longer or something, dont hold me on it lol)

Here is a search facility for checking actual real trademarks:
http://www.ipo.gov.uk/tm/t-find/t-find-text/

If you put in 'zillion' you can see its actually been registered at least three times, one by a toilet product manufacturing company!
http://www.ipo.gov.uk/tm/t-find/t-find- ... rk=1585481

I don't see any registration from hospitality. What they probably mean is that they havent actually made it a 'tm', but its an established artist name, and they don't want you treading on thier toes.

The thing is, this happens all the time anyway. Think about it, you've got dubstep's Quest, and break's DJ Quest (cyberfunk). Dubstep's 'Formula' and about 20 other hip hop guys also called Formula. Theres Brighton based d&b DJ Yougster steppin on the real Youngsta's toes.

At the end of the day you reside within your own scene so it ultimately might never matter, oh unless your called Bad Company, try and release an album and realise there is a long established rock group with the same name so have to rename yourself to )B|EC or something..

Plasticman / Plastician.... its neverending

in all seriousness...just ignore their socialist nonsense. they are trying to set up a monopoly on that name, and if you can use it and do it better then fuck them.

It's like the Dust Brothers having to rename themselves the Chemical Brothers.

The trick is finding something - somehow - that hasn't been used. Even then it'll probably crop up in some obscure music scene in Central Asia.

Good luck!!

please, if you hate me so bad then just ignore my stupid, ill-informed views. just feel good that you've exposed me for not knowing what socialist means. im pretty sure that i must look ridiculous and that this must matter heaps..

i saw an dnb mc on a flyer called Crazy Dee.
shameful.

i call myself £12.50 Bag for any dubstep stuff now, to avoid confusion with the label.
its not exactly a big deal man, just call yourself Zillion Ten Thousand or something

i got a message like that a few years ago when i was making some weird noise and calling it music. apparently i had picked a name that was in use by some popular indie rock band.

our music sounded nothing alike, but i still got messages frequently from people wanting to book the other band... i considered showing up to the gig and performing my own stuff...

i eventually just got tired of all those kids adding me and asking me if the whole new album was gonna sound like the tracks i added

if its in the same realm music wise, and you aren't really established, i'd just change your name... its not really that good of a name anyway

LOL, That's even worse than putting UK after your name, or DJ before it.
It would be good for when/if you branch out to making other genres of music though... Zilliandubstep, big in teh funky house scene.

On topic again, one of my aliases is Azrael, there are fucking tonnes of Azraels. Most of them are metal bands though and there are no other releases in the DNB world by another Azrael so I have never really encountered a problem. I haven't had any disgruntled Azraels messaging me on myspace yet...
