Is he guilty or not?
Don’t worry about people stealing an idea. If it’s original, you will have to ram it down their throats.

There are some blatant rips out there that can easily be brought into court, this is not one.
when you have to change the key, tempo, instrumentation to get the melody in the same ball park (where it's still questionable) then no. Some people spend far too much time trying to find these things, and they are there because subconsciously that's how we create, we regurgitate what has been done in our own way. It's been done for centuries, it will be done for centuries to come.

Who cares he just sampled it. Sure look at the prodigy they have blatently ripped artists off before. However I'm sure they got permission
Re: Is he guilty or not?
This just in, if you stretch & pitch a melody that consists of a handful of notes, you can probably make it sound like another one.
