A certain evil distribution company has refused to send me sales reports since December and is withholding over $3000 in funds due.

I need some serious guidance / suggestions from the community. What is the best course of action to take?

I will disclose the distribution company to everybody once this is cleared up.

I'd hold fire on the suing for the moment....... a solicitor will charge from the off and will want to look through any contracts and see how often they promised to submit a statement to you / make payments etc. If you don't have a written contract then they will have to work on a type of good faith which, I guess in this situation would be inferred from the regularity of the statements you received prior to this happening. I would also imagine that, because this is music they may just refer you to a specialist music lawyer which can be fairly pricey.

Under UK law you're entitled to audit the company as a business partner at any time so I'd have a look at UK based accountancy firms that operate such a service and choose one in the same city / area as them. You may have to pay something to get this done but it certainly won't be anywhere near the 3 grand you say you're owed and, if there is an issue which, clearly there seems to be, then you would be able to claim the fee back from the company in question as well. It might be worth letting the distribution company know that you are planning to do this if they don't respond positively though. Not as a threat I hasten to add, more as a courtesy because ultimately someone will have to pay an extra cost and it's worth trying to sort these things out amicably as there could be any number of reasons for such a situation.

You may need to have some evidence of a working relationship with them but, if you don't have a written contract then previous statements from the company to your company would suffice. If they refuse any audit then you would have a stronger case to take to a solicitor.

^^ impossible, since they were digital releases....there is no way for them to lose money. And our first release broke the top ten on Juno, Track-It-Down, and Beatport so I know we pushed major units TYVM!!
