I've studied intellectual property law and I'm fairly sure that's not the case. It's more a question of whether the copyright holder of the source material is aware of the infringement, and whether they decide to pursue if they are. For a generic dubstep tune with 4sec of Danny Dyer going "YOU CAAAAAAAAAAAAAAAANT" before the drop, I doubt they'd be interested.

Not strictly true. Behaving aggressively online isn't a good luck, irrespective of your motives.

That's 800+ views of the topic, not 800+ unique page impressions. A fair chunk of those would be from the original poster (i.e. you) and the people you were having discussions with.

To be honest Id assume a decent label would make sure that every sample is royalty free before release??? Ive heard of people being asked to take samples out in case the owner ever sued.

We cover it by using standard release forms, a little form stating the artist is not aware of any sampled or copyrighted material. Then any damages the label would bare the brunt of fall squarely on the producer. Realistically, depending on the sample source, most people won't give two shits because you won't make enough money off the release to go through the effort and expense of court to only get the royalties from a release that sold 700 units.

And to be perfectly honest, we've (and every other label I know of) has put out music with uncleared samples, you just got to go in eyes open and be prepared to back up your artists and take the flak should it kick off (like it has done for us).

This and that 5 second thing is a complete balls. Any usage of someone else's work is supposed to go through the appropriate measures. You should read up on sampling laws and such, it's not THAT boring (tho a lot of it IS that boring). There are exemptions from having to declare sampling, such as an indistinguishable sample or for the use of satire, but you'd be hard pushed to use the latter in defence of some free giveaway mp3.

Fair play i did wonder how labels would protect themselves against less honest artists.
I still stand by what I said in t'other thread though bad publicity is bad publicity if your serious Id change the name website and your attitude. Theres some seriously fucking good unsigned people on here that youve alienated. Id look at similar small labels and see how theyve gone about it.

Goldie said that on Radio 1 though right?
Do you see the difference here...
GOLDIE said this on RADIO 1, AFTER people had bought thousands and thousands of his records.
Not while trying to get artists for his label on a forum and driving his core market away.

Why do you even want other artists though?
You're label is clearly just a way to get your tunes released because you don't have the social skills to approach a proper label.
