Foul Play Records trying to steal tunes AGAIN

Post by AMPR » Fri Mar 09, 2012 10:19 pm

So the last thread got locked, sorry about the screenshots, didn't know that I couldn't post them, but I had to bring them out to public.
I know there has been stuff like this before with this label, and I just found out when I was about to do a EP for them.
Now, they are going to use my originals to make a release without my permission, is there anything I can do??

If you've signed a contract for the tunes, Foul Play can release them.
If you've not signed any form of contract, and have only made 'gentlemen's agreements' over AIM or whatever - they 100% have NO right to any of your music.
If he goes ahead and releases your music anyway (it wouldn't surprise me given his reputation) then it turns in to a legal matter and realistically you'll need a lawyer to do anything about it.

My advice - tell him straight-up, preferably via a recorded telephone call, that you 100% do not want your music released on their label.

Good luck man! It's sad to see how some labels go on. I suggest you contact some of the other unlucky (and unwanted!) Foul Play artists from this thread - http://www.dubstepforum.com/viewtopic.php?f=1&t=123385

Yeah the "agreement" was me saying I want to release tunes on the label on AIM, and that was before I had seen any of the threads.

I've had a few classes about common law systems, don't you guys fully validate verbal contracts? Then, by analogy, even if you said it through aim, it's still a verbal contract as you implied a desire to release the tunes. As a civil/roman law school student I'd say first try to prove that the label acted in bad faith, deceiving you in order to steal your intelectual propriety and coercing you into signing a leonine contract. Not that simple and also different law systems, just my two cents.

You may have stated on AIM your interest in him releasing your music but if nothing is signed AND you now specifically say you want to back out, he would then be liable. If you are in UK it only costs £30 to represent in a small claims court and you can reclaim that anyway. This guys should be ashamed and puts all us label owners in a bad light.

What a floppy penis.

I've been getting in touch with the people who have dealt with this, just trying to figure out what would it take to shut down this guys distribution channels. There are so many people who have been fucked over (at least the older threads say that), and I just heard that Prolific tried to do this same thing to a fellow producer about two weeks back.

It depends on the weight of the agreement, people can enter contracts orally and agree to oneandother's terms and conditions - if these guys are using material without your permission, and you have not entered into a contract, you can start a civil court action. However, it's expensive and time consuming, but to be on the safe side, I'd probably go to a free law clinic (they usually have them on specified nights/times) where a proper solicitor will advise you on your options!

Hope this helps!

No shit? That's fucked up!
An 'oral contract' sounds like a joke to me unless the conversation is recorded

Did you just say you were interested in releasing on the label or did you specify which tracks you were interested in releasing?
