They just took my tune. Didn't even have permission. They did this after I explicitly stated that I had no desire to release on their label... What the fuck?

Is there some kind of report fubction on iTunes?
I heard of this happenning, Foul Play was notorious for thay iirc... Try to report it/ask them to take it down (assuming they reply)/give away the tune for free...

Sucks mate

thing is, it was already a free tune before hand, he asked to remix it, and took the tune itself...
Reason I didn't want to release with this clown again was because he didn't even pay on the last release either. Good small labels are fucking hard to find...

Maybe you signed your rights over to him?
If he is wantonly violating your copyright, as you seem to think, you may be entitled to $150,000 in damages here in the US. That is independent of his financial gain. You could buy, like, half of your software.

There was no contract sent from him to me, I've got screen shots of our convos where I did clearly say I didn't want this tune to be released.
Tbh I'm not doing this for money, I'm doing this for the sake of anyone else they approach. Not saying that my experience with the label is the rule, but look out, it's not the first label I've had practical issues with...

If anything I would at least contact Itunes and report what they did. Chances are they aren't going to make any money. You said you already had it up for free and chances are people will find that before they pay for it. Trying to sue them may yield absolutely nothing because they probably won't have any money to give you. But this dude/label definitely shouldn't be allowed to continue pulling this crap.

spend like 500 quid buying the song over and over again and then sue him for damages.

Again, don't need any sales to get damages.

not much you can do besides reporting to iTunes
dont think anyone who's replied has realised 'sueing' him would cost a bomb and be a complete waste of time

Thats what i was gonna say, why waste all tha time and money when you should be able to get them to tke the tune down yourself.. If not go to there main office (if they even have one) and beat the shit out of him?
