Samples and Copyright Laws

I'm using a sample from a stand up comedians special and was wondering if I would run into any copyright problems, and if so, how would you recommend getting permission to use the sample

You'll be sued by all the other producers who used the same samples first...in the 90's...when it was hip...in the 90's.
