can you appeal against the summons, if it weren't you (diff surname) then you shouldn't even have to go to court

my flatmate just had exactly the same thing happen to her. she called them up and after a conversation she came away with a £100 fine as opposed to a criminal record. not sure about the last name thing tho - i would suggest you don't play the 'wrong name' card, as you're in for a more severe penalty if they bust you for misleading them as well.
good luck von

You can say you thought you lost your pass but it turned up later..
..go to a newsagents who still use the old stamp method on the passes (as opposed to the electronic-pop-out-of-a-machine ones), be very nice, and ask them to date your pass the day you bunked the bus.
Should work.. they told me (when I was caught once) that if my pass turned up I can appeal.
Go figure..
(ps. I gave them some old student address in Notts. Both times I was caught. I've heard nothing in over two years.)

I think you are lucky, on the tram they have these machines that KNOW EVERYTHING.
"How many people live in your house?"
and if you don't know the answer, they know you are lying. Police patrol with them now too.

True.. but it seems like long ting to get the CCTV for that specific journey.. i suppose they will do it if they have to convict me.

IMO mate i would try & get some legal aid because ure laughing in that respect with the name thing, theres no way they can prove it was you..
but i dont think magistrates is like that, ive always been to crown court, i think in a magistrates you are to be sentanced with a load of other peeps, as it isnt as important as other legal dilemmas, so in that case i just wouldnt turn up..haha

yeah i dont know much aboput this issue, however the transport police are pretty on it now, they actively look to prosecute people so i wouldn't take any chances really. i agree with deams that you should try get some legal advice
