Is this illegal?

Go check out the mix forum. Welcome to that Ebay auction. Technically if you didn't produce the track, even if you bought it on vinyl you have no legal right to play the track in a mix, or live if you want to wax philosophical about it.smartface wrote:deffs illegal. he doesn't have rights to the show or any tunes played on it.
WTF!? They're not selling the mixes!Surface_Tension wrote:Go check out the mix forum. Welcome to that Ebay auction. That doesn't matter. You don't purchase performance rights when you buy a CD, correct? This material may not be broadcast, performed, etc... read the fine print next time you buy a CD. You purchase a license to listen to and make one copy of for personal use. You have no right to distribute, or otherwise share, including derivative works. I'd be happy to have my lawyer explain it. Fear not, you can most assuredly play the living piss out of our records that come from our label. But if we wanted to be assholes, we could legally put a stop to it. Ask any major club owner who has to pay royalties out the ass just to stay in business.spooKs wrote:WTF!? They're not selling the mixes!Surface_Tension wrote:Go check out the mix forum. I'm definitely aware that it's as illegal technically, I'm just morally against some guy making profit off of it. The initial question was is it illegal, and yes, technically it is.Surface_Tension wrote:That doesn't matter. You don't purchase performance rights when you buy a CD, correct? Are you condoning the behaviour of the ebay poster? If not, you're just digressing for the sake of being pedantic!Surface_Tension wrote:That doesn't matter. nah not this particular one, which I think is from the mary anne hobbs show. I see your point though.Uncle Clement wrote:the broadcast itself is probably illegal.
I'm saying that if you aren't prepared to do something about it, it's legal. It may be shady, but what are you going to do? If you support the mix forum, you support the Ebay poster. pretty clear.spooKs wrote:Are you condoning the behaviour of the ebay poster? If not, you're just digressing for the sake of being pedantic!

I'm with ya on this. Both parts actually. I'm against it as well.smartface wrote:I'm definitely aware that it's as illegal technically, I'm just morally against some guy making profit off of it. The initial question was is it illegal, and yes, technically it is.
Off topic: big up on the release.
I disagree. Your rationale of "since no one is willing to do anything about it, its legal" is flawed. Its illegal, as you yourself pointed out in an earlier post. Regardless of if someone is gonna do something about it, it is. If its not, your lawyer fed you a bunch of BS.Surface_Tension wrote:I'm saying that if you aren't prepared to do something about it, it's legal. It may be shady, but what are you going to do? look at the price... hardly the cost of a CD init. he's selling a CD that happens to contain data. market it that way and nobody says anything legally. sad but true.
